Terms of Service

Welcome to Hirfa. These Terms of Service govern your access to and use of Hirfa. By creating an account or using the product, you agree to be bound by these terms.
1. Accounts and Organizations
To use Hirfa you must create an account through our authentication provider (Kinde). Each account belongs to one or more organizations, and every organization receives its own isolated workspace.
- You are responsible for keeping your credentials safe and for any activity that happens under your account.
- You must be authorized to act on behalf of any organization you create or join.
- Roles within an organization (Owner, Admin, Member) define what each user can do. Owners are ultimately responsible for the organization, its data, and its billing.
2. Acceptable Use
You agree to use Hirfa only for lawful purposes and in a way that does not infringe the rights of others. In particular, you must not:
- Upload content that is illegal, harmful, infringing, or that you do not have the right to store or share.
- Attempt to break, probe, or circumvent the security of Hirfa, its infrastructure, or other organizations' data.
- Use the AI assistant to generate content that violates applicable law or our providers' usage policies.
- Resell, sublicense, or redistribute Hirfa without our written permission.
- Use automated means to scrape, overload, or disrupt the service.
3. Your Content
You retain full ownership of the resources, records, files, dashboards, automations, and chat messages you create in your workspace. By using Hirfa, you grant us a limited license to host, store, transmit, and process this content solely to operate the service for you.
You are responsible for ensuring you have the right to store any content you upload and that it complies with applicable law.
4. AI Features
Hirfa includes an AI assistant that can design, modify, and manage your workspace structure on your behalf. By using these features you acknowledge that:
- AI output may be inaccurate, incomplete, or unsuitable for your specific use case. You are responsible for reviewing it before relying on it.
- Structural changes proposed by the AI are presented for confirmation before they are applied. Confirming a change is your decision and your responsibility.
- AI usage is subject to the message and token quotas of your subscription plan. Quotas reset on a monthly cycle.
- Your prompts and workspace context are sent to our AI provider as described in the Privacy Policy.
5. Plans, Billing, and Trials
Hirfa is offered through subscription plans. Each plan defines its own seats, AI quotas, and feature access. Billing is handled by Stripe, our payment processor.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- You can manage your subscription, payment method, and invoices at any time through the Stripe-hosted billing portal accessible from your organization settings.
- Cancelling a subscription stops future renewals. Access continues until the end of the current paid period.
- Except where required by law, payments are non-refundable.
- Trial periods, if offered, convert to a paid subscription unless cancelled before the trial ends.
6. Data, Sync, and Availability
Hirfa is offline-first: your data lives on your device and syncs with our servers when connected. We work to keep the service reliable, but we do not guarantee uninterrupted access. Maintenance, outages, or events beyond our control may occasionally affect availability.
You are responsible for maintaining your own backups of critical data where appropriate. Record deletion within Hirfa is permanent and cannot be undone.
7. Third-Party Services
Hirfa relies on third-party providers to deliver the service, including authentication (Kinde), payments (Stripe), and AI providers. Your use of Hirfa is also subject to the terms of these providers where applicable. We are not responsible for the practices or availability of third-party services beyond our reasonable control.
8. Intellectual Property
Hirfa, including its software, design, branding, and documentation, is owned by us and protected by intellectual property laws. These terms do not transfer any ownership of Hirfa to you. You may not copy, modify, reverse engineer, or create derivative works of the product except as expressly permitted by law.
9. Suspension and Termination
You may stop using Hirfa at any time and request the deletion of your account or workspace as described in the Privacy Policy. We may suspend or terminate access to an account or organization if:
- These terms or our acceptable use rules are violated.
- A subscription remains unpaid after a reasonable grace period.
- Continued use poses a risk to the service, other users, or third parties.
On termination, your right to use Hirfa ends. We will handle any remaining workspace data according to the Privacy Policy.
10. Disclaimers
Hirfa is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or meet your specific requirements.
11. Limitation of Liability
To the maximum extent permitted by law, Hirfa and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the service. Our total liability for any claim related to Hirfa will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
12. Governing Law and Jurisdiction
Hirfa is operated from the Province of Quebec, Canada. These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or relating to these terms or your use of Hirfa will be brought exclusively before the courts of the judicial district of Montreal, Quebec, Canada, and you consent to their personal jurisdiction. Where applicable consumer protection laws grant you the right to bring proceedings in your place of residence, this clause does not override that right.
13. Changes to These Terms
We may update these terms as Hirfa evolves. When we make material changes, we will notify you through the application or by email. Continued use of Hirfa after changes take effect constitutes acceptance of the updated terms.
